Efficiency of competent state authorities in detecting and approving criminal reports of violent property crime

AB  - Violent property crime is a specific category of crime against property, primarily because of its complexity, which stems from the importance of the protected property, the frequency, methods and means of enforcement, but also the extent and intensity of the consequences caused. The aim of this research was to examine the effectiveness of competent state authorities in detecting and prosecuting perpetrators of these crimes. The research was designed as a cross section study. The sample consisted of all police actions, decisions of the prosecutor's office and courts related to the criminal acts of robbery theft, robbery and extortion in the territory of the Republic of Serbia, for which the criminal procedure was concluded in the period from 2007 to 2012. The data was obtained from the Ministry of Internal Affairs and the Republic Institute for Statistics, and part of it was taken from the European Original Crime and Penal Policy published by the European Institute for Prevention and Control of Crime from Helsinki (ESCCJS). The results of the survey show the decent effectiveness of the police in clarifying these crimes, as well as the incoherent cooperation between the police and the prosecution in prosecuting offenders of violent crime.
AB  - Насилнички имовински криминалитет представља специфичну категорију криминалитета против имовине, пре свега због његове сложености, која проистиче из значајем заштићеног добра, учесталости, начина и средстава извршења, али и обима и интензитета проузрокованих последица. Циљ овог истраживања био је да се сагледа ефикасност надлежних државних органа у откривању и гоњењу учинилаца ових кривичних дела. Истраживање је дизајнирано као студија пресека. Узорак су чинила сва поступања полиције, одлуке тужилаштва и судова које су се односиле на кривична дела разбојничке крађе, разбојништва и изнуде на територији Републике Србије, за које је поступак по кривичној пријави окончан у периоду од 2007 до 2012. године. Подаци су добијени од Министарства унутрашњих послова и Републичког завода за статистику, а део је преузет из Европског изворника о криминалитету и казненој политици у издању Европског института за превенцију и контролу криминала из Хелсинкија (ESCCJS). Резултати истраживања показују пристојну ефикасност полиције у расветљавању ових кривичних дела али и некохерентну сарадњу полиције и тужилаштва у процесуирању учинилаца кривичних дела насилничког имовинског криминалитета.

Bones as forensic evidence

AB  - Forensic anthropologists use the theory and techniques of biological anthropology to determine how recently individuals lived and died. They study skeletal remains from crime scenes, wars and mass disasters within the very recent past to reveal the life history and identity of an individual, and to understand the context in which death occurred. During excavation, in order to ensure full recovery and good contextual information, osteologists rely on archaeological techniques to find, document and remove skeletal remains from their in situ conditions. At the crime scene, an anthropologist makes a preliminary determination of whether the remains are human or nonhuman and whether more than one individual is present. Once exposed and mapped, individual bones are tagged, bagged, and removed to the laboratory for more detailed curation and examination. A strict chain of custody is established to ensure that the remains cannot be tampered with, in case they represent evidence in a court of law. Once the initial inventory has been completed, a scientist sets about evaluating the clues that the skeleton reveals about the life and death of the individual. The first step in this process is constructing the biological profile of the individual, which includes determining the age, sex, height, ancestry and disease status. Ultimately, forensic anthropologists try to establish the identity of a victim. Once they have several possibilities, they can compare a number of different ante-mortem records (dental records, surgical implants, DNA records, and the matching of ante-mortem and post-mortem X-rays) to try to establish a person’s identity. Although forensic anthropologists most often work on cases of lone victims of homicide, suicide, or accidental death, they are also called to the scenes of mass fatalities, to search for soldiers killed in combat, and to investigate human rights abuses that result in hidden or mass graves.

Physician-assisted Suicide in Serbia

AB  - Background: Physician-assisted suicide is one of the features with very different legal solutions in the world. In Serbia, physician-assisted suicide is a crime, within a crime of the assisted suicide. The possibility of the legislation of the voluntary active euthanasia may open the door to the decriminalization of the physician-assisted suicide. Methods: Data were obtained from the Clinical Hospital Center in Kragujevac, Republic of Serbia collected during 2015. The research included 88 physicians: 57 male physicians (representing 64.77% of the sample) and 31 female physicians (35.23% of the sample). Due to the nature, subject, and hypothesis of the research, the authors used descriptive method and the method of the theoretical content analysis. Results: We have raised numerous questions. A slight majority of the physicians (58%) believes that physician-assisted suicide should be legalized, while 42% is for another solution. 90.9% took a viewpoint that it is completely unacceptable legalization of the physician-assisted suicide for all age groups, while the remaining 9.1% is to such legislative move. From the other side, 40.7% of respondents would prescribe a lethal dose of the medicament to the patient, who is in the terminal stage of the incurable disease, but, 59.3% would not do it. Interesting is that 13.8% of the physician had a patient who asked for the information how to commit suicide, and 12.5% gave them such information. Conclusion: Physicians in Serbia are divided on this issue. The majority of them are for the legalization of medical assistance to suicide, but there is a strong division among them on various issues.

An Ethical Review of Euthanasia and Physician-assisted Suicide

AB  - Background: In the majority of countries, active direct euthanasia is a forbidden way of the deprivation of the patients' life, while its passive form is commonly accepted. This distinction between active and passive euthanasia has no justification, viewed through the prism of morality and ethics. Therefore, we focused on attention on the moral and ethical implications of the aforementioned medical procedures. Methods: Data were obtained from the Clinical Hospital Center in Kragujevac, collected during the first half of the 2015. The research included 88 physicians: 57 male physicians (representing 77% of the sample) and 31 female physicians (23% of the sample). Due to the nature, subject and hypothesis of the research, the authors used descriptive method and the method of the theoretical content analysis. Results: A slight majority of the physicians (56, 8%) believe that active euthanasia is ethically unacceptable, while 43, 2% is for another solution (35, 2% took a viewpoint that it is completely ethically acceptable, while the remaining 8% considered it ethically acceptable in certain cases). From the other side, 56, 8% of respondents answered negatively on the ethical acceptability of the physician-assisted suicide, while 33% of them opted for a completely ethic viewpoint of this procedure. Out of the remaining 10, 2% opted for the ethical acceptability in certain cases. Conclusion: Physicians in Serbia are divided on this issue, but a group that considers active euthanasia and physician-assisted suicide as ethically unacceptable is a bit more numerous.

Normative framework for combating trafficking in human organs

AB  - Trafficking in human organs is a specific and complex criminal phenomenon that takes place in several phases, with the participation of a large number of actors, often covering several jurisdictions. To effectively countering are necessary conceptual and terminological demarcation of organ trafficking from other similar phenomena, fundamental scientifically research of its shape and dynamics, and the construction of an adequate legislative framework, both at the national and international level. This paper first analyses the conceptual - terminological framework in which research of organ trafficking is range, and then presents a review and analysis of the development of ethical and normative international standards aimed at prevention and suppression this phenomenon. In the end, we analysed the current solutions in the domestic legislation. Nowadays, there are two parallel legislative regime that regulate the matter of organ trafficking. The first legislative regime that organ trafficking treated exclusively as a modality of transnational crime of human trafficking, and a second, recent, that organ trafficking treats as forbidden (incriminating) activity that violates a regulatory system of organ (tissue cells) transplantation.
AB  - Trgovina ljudskim organima je specifična i složena kriminalna pojava, koja se odvija u više faza, uz učešće većeg broja aktera, često obuhvatajući nekoliko jurisdikcija. Za efikasno suprotstavljanje toj pojavi neophodni su pojmovno i terminološko razgraničenje trgovine organima od drugih sličnih pojava, naučno fundirano istraživanje njenih oblika i dinamike, te izgradnja adekvatnog normativnog okvira, i na nacionalnom i na međunarodnom nivou. U ovom radu prvo je analiziran pojmovno-terminološki okvir u kome se kreću istraživanja trgovine organima, a zatim je izložen pregled i analizan razvoj etičkih i normativnih međunarodnih standarda usmerenih na sprečavanje i suzbijanje te pojave. Na kraju su analizirana aktuelna rešenja u domaćem zakonodavstvu. Danas paralelno postoje dva normativna režima koja regulišu materiju trgovine organima. Jedan trgovinu organima tretira isključivo kao modalitet transnacionalnog krivičnog dela trgovine ljudima, a drugi, noviji, kao zabranjenu (inkriminisanu) delatnost kojom se krši normativni sistem koji reguliše transplantaciju organa (tkiva, ćelija).

AB  - In the paper authors analyze the principle of opportunity of criminal prosecution in the positive legislation of criminal procedure of Republic of Serbia. The principle of opportunity, as one of the simplified forms of procedure, enables public prosecutors to drop criminal charges regarding minor criminal offences, with the aim of relieving the criminal justice system and to allow the courts to deal with serious criminal cases. However, the question is whether this aim is achieved or not. The research of application of principle of opportunity in the proceeding against adults in the practice of Primary and Higher prosecution in Kragujevac is presented in the paper, as well as the analysis of the research results, based on which it can be concluded that this principle is very restrictively applied in the practice.
AB  - Autori u radu analiziraju načelo oportuniteta krivičnog gonjenja u pozitivnom krivičnom procesnom zakonodavstvu Republike Srbije, sa posebnim osvrtom na pojam i svrhu ovog načela. Oportunitet, kao jedna od pojednostavljenih formi postupanja, ima za cilj da omogući javnim tužiocima da odbace krivične prijave kod izvršenja lakših krivičnih dela, a sve u cilju rasterećenja krivičnog pravosuđa i omogućavanja sudovima da se bave ozbiljnijim krivičnim predmetima. Međutim, postavlja se pitanje da li je ovaj cilj u praksi i postignut. U radu je dat i prikaz sprovodenog istraživanja o primeni načela oportuniteta u postupku prema punoletnim licima u praksi Osnovnog i Višeg tužilaštva u Kragujevcu, kao i analiza rezultata istraživanja, na osnovu koje se može zaključiti da se oportunitet u praksi dosta restiktivno primenjuje.

AB  - Scientific and professional community, and political subjects, both at national and at the international level have a unique position that organized crime is now one of the most dangerous security threats. However, such consent does not exist in terms of conceptual determination, identification, dimensions and of choice of methods to counter organized crime. The first part of this article describes the main trends in the conceptual definition of organized crime, social and political context of the use of this term and the subjects who have contributed to it becoming one of the main concepts of modern scientific and professional discussions about crime. The second part indicates the dynamics of organized crime as a security threat in the territory of Europe, and the last part presents and analyzes the development of organized crime in Serbia and attitudes of scientists and experts, political entities and state bodies and institutions towards this phenomenon.
AB  - Naučna i stručna javnost, ali i politički subjekti, kako na nacionalnom tako i na međunarodnom planu, imaju jedinstven stav da organizovani kriminal danas predstavlja jednu od najozbiljnijih bezbednosnih pretnji. Međutim, takva saglasnost ne postoji u pogledu pojmovnog određivanja, identifikovanja, razmera i izbora metoda za suprotstavljanje organizovanom kriminalu. U prvom delu rada predstavljeni su osnovni trendovi u pojmovnom definisanju organizovanog kriminala, društveni i politički kontekst upotrebe ovog pojma i akteri koji su doprineli da on postane jedan od glavnih koncepata savremene naučne i stručne diskusije o kriminalu. Drugi deo rada ukazuje na dinamiku razvoja organizovanog kriminala kao bezbednosne pretnje na području Evrope, a poslednji deo prikazuje i analizira razvoj organizovanog kriminala u Srbiji i odnos naučne i stručne javnosti, političkih subjekata i državnih organa i institucija prema ovom fenomenu.

Protection of the right to trial within a reasonable time in the legal system of Serbia

AB  - One of the fundamental rights guaranteed by the European Convention on Human Rights and Fundamental Freedoms and the Constitution of Serbia is entitled to trial within a reasonable time, as a component of the right to a fair trial. The protection of this right in Serbia's legal system has gradually evolved from the position that there is no effective remedy for his protection, until the adoption of a special law which protects this right in an integrated and comprehensive manner. In this article analyzed the legislative instruments which on the one hand guarantee, and on the other hand provide judicial protection of the right to trial within a reasonable time. Especially critically analyzed the role of the Constitutional Court in proceedings on constitutional appeals, the role of the regular courts and finally the provisions of the new Law on the Protection of the right to trial within a reasonable time, with a comparative analysis in relation to the relevant law of the European Court of Human Rights.
AB  - Jedno od osnovnih prava garantovanih Evropskom konvencijom o ljudskim pravima i osnovnim slobodama i Ustavom Srbije je pravo na suđenje u razumom roku, kao komponenta prava na pravično suđenje. Zaštita ovog prava u pravnom sistemu Srbije postepeno je evoluirala, od stava da ne postoji delotvorno pravno sredstvo za njegovu zaštitu, do donošenja posebnog zakona koji ovo pravo integralno i na sveobuhvatan način štiti. U ovom radu analizirani su legislativni instrumenti koji sa jedne strane garantuju, a sa druge strane pružaju sudsku zaštitu prava na suđenje u razumnom roku. Detaljnije su kritički analizirani uloga Ustavnog suda u postupcima po ustavnim žalbama, uloga redovnih sudova i na kraju odredbe novog Zakona o zaštiti prava na suđenje u razumnom roku, uz komparativnu analizu u odnosu na relevantnu praksu Evropskog suda za ljudska prava.

Corporate violations of human rights and possibilities of criminal-law protection

AB  - Corporate crime became a serious criminal phenomenon on a national, regional, and global level. The fact that a large number of states have decided to start punishing corporations with criminal sanctions is the result of an objective examination of social reality, which has unequivocally shown that serious crimes are continually committed on behalf of and for the benefit of legal persons, and that those acts inflict serious damage to states, society, and individual rights. This paper explains the concept and the main characteristics of corporate crime and presents its similarities with and differences from related forms of criminal conduct. The violation of human rights by legal persons is classified according to the object of criminal-law protection, i.e. according to the nature and importance of the right that has been violated. Review and analysis of paradigmatic examples of threats and violations of human rights include criminal activities of legal entities in the fields of protection of life, liberty and security, political rights, environmental and human health, and the right to safe and healthy work. The paper then presents prominent cases of corporate violations of human rights and analyzes the concept of corporate criminal liability as an adequate response to the challenges of corporate crime. Finally, the paper provides an overview of Serbian criminal legislation in this field.
AB  - Kriminalitet pravnih lica postao je ozbiljan kriminalni fenomen na nacionalnom, regionalnom i globalnom planu, a kršenja ljudskih prava kojima se ispunjavaju obeležja bića pojedinih krivičnih dela, samo su deo ukupnog kriminalnog delovanja mnogih korporacija širom sveta. Autori ekspliciraju pojam i osnovne karakteristike kriminaliteta korporacija, analizirajući njegove sličnosti i razlike sa srodnim kriminalnim fenomenima, a zatim prikazuju poznate slučajeve krivičnih dela protiv sloboda i prava čoveka i građanina, učinjena u ime i za račun korporativnih ekonomskih giganata. Autori klasifikuju povrede ljudskih prava od strane pravnih lica po objektu krivičnopravne zaštite, to jest po vrsti i značaju povređenog prava. Prikaz i analiza paradigmatičnih primera ugrožavanja i povrede ljudskih prava obuhvataju kriminalno delovanje pravnih lica u oblastima zaštite života, slobode i bezbednosti, političkih prava, zaštite životne sredine i zdravlja ljudi, te prava na bezbedan i zdrav rad. Nakon toga, autori se fokusiraju na analizu mogućnosti krivičnopravne rekacije, imajući prevashodno u vidu uvođenje odgovornosti pravnih lica za krivična dela kao adekvatan legislativan odgo-vor izazovima kriminaliteta korporacija. Konačno, autori prikazuju i analiziraju domaće pozitivnopravne norme o odgovornosti pravnih lica za krivična dela.

Euthanasia: Murder or Not: A Comparative Approach

AB  - Background: Euthanasia is one of the most intriguing ethical, medical and law issues that marked whole XX century and beginning of the XXI century, sharply dividing scientific and unscientific public to its supporters and opponents. It also appears as one of the points where all three major religions (Catholic, Orthodox, and Islamic) have the same view. They are strongly against legalizing mercy killing, emphasizing the holiness of life as a primary criterion by which the countries should start in their considerations. Studying criminal justice systems in the world, the authors concluded that the issue of deprivation of life from compassion is solved on three ways. On the first place, we have countries where euthanasia is murder like any other murder from the criminal codes. Second, the most numerous are states where euthanasia is murder committed under privilege circumstances. On the third place, in the Western Europe we have countries where euthanasia is a legal medical procedure, under requirements prescribed by the law. In this paper, authors have made a brief comparison of the solutions that exist in some Islamic countries, where euthanasia is a murder, with Western countries, where it represents completely decriminalized medical procedure.

Criminal procedural protection of juveniles: National and comparative solutions

AB  - The authors consider in work different aspects of criminal proceeding protection of minors in Republic of Serbia and in several European countries. These young people can participate in criminal proceeding on the one hand as witnesses. It usually means that they are also injured but there are situations when that’s not the case. There are set of rules which refer to protection of minors in criminal proceeding when they are injured. Also some new rules which relate to measures of protection of particularly sensitive witnesses was recently adopted. These new rules offer protection for all such witnesses (including minors) regardless of they are injured or not. It is also important to protect minors in criminal proceeding when they are accused because of necessity of regular development of their personality and some special rules are established for that reason in our country. Some states of the former Yugoslavia in a similar way as Serbia regulate the protection of minors in criminal proceedings, such as Croatia and Macedonia. The examples of Germany and France are also given in work. Germany is specific because of the rules which refer to the protection of juvenile offenders, while France has significantly improved the protection of juvenile victims of crime.
AB  - U radu autori razmatraju različite aspekte krivičnoprocesne zaštite maloletnih lica u Republici Srbiji kao i u pojedinim evropskim državama. Sa jedne strane, maloletna lica mogu učestvovati u krivičnom postupku kao svedoci. To će obično značiti da su ta lica istovremeno i oštećena krivičnim delom, ali postoje situacije, kada to nije slučaj. Kod nas postoji niz pravila koja se odnose na zaštitu maloletnih lica, kao oštećenih u krivičnom postupku. Nedavno su usvojena i neka nova pravila koja se tiču mera zaštite posebno osetljivih svedoka. Ta nova pravila pružaju zaštitu svim svedocima (uključujući i maloletna lica), bez obzira da li su oštećeni krivičnim delom. Takođe je važno zaštititi okrivljena maloletna lica u krivičnom postupku zbog neophodnosti pravilnog razvoja njihove ličnosti, i u tom smislu, kod nas postoje odgovarajuća pravila. Pojedine države bivše Jugoslavije, na sličan način, kao i Srbija regulišu zaštitu maloletnih lica u krivičnom postupku, poput Hrvatske i Makedonije. U radu su navedeni i primeri Nemačke i Francuske. Nemačka je specifična zbog pravila koja se odnose na zaštitu maloletnih učinilaca krivičnih dela, dok je Francuska u značajnoj meri unapredila zaštitu maloletnih žrtava krivičnih dela.

Phishing schemes - typology and analysis in Serbian cyber space

AB  - Purpose: The purpose of this paper is to identify and describe various factors for understanding criminal behaviour involved in phishing and to provide advice in the areas of security, criminal procedure, and victimology. Design/methodology/approach: The project combined several qualitative and quantitative techniques such as interviews and surveys, as well as content analysis. Findings: Several categories of subjects were identified: those who are aware of some scientific achievements in this field and who feel increasingly apprehensive about the disclosure of private information; those who are not prepared to readily incorporate scientific progress in similar fields; the third category includes staff members who do not embrace all new measures in the fight against this type of cybercrime. The participants could also be categorized on the basis of their inclination to recognize new forms and types of phishing: some are aware of new forms and can recognize them as soon as they emerge locally; others cannot do so. Research limitations/implications: To allow findings to be generalized, future research should include measures that could specify additional means to be used by members of a wider representative group, such as tools, materials, educational and course modules, implemented during training. Practical implications: This research represents a useful source of information for method implication in combating phishing schemes, and for detecting new emerging forms and types of cybercrime promptly, as well as new social engineering methods to facilitate it. Originality/value: This paper should be of particular interest to forensic specialists, in the analysis of crime scene behaviour and of methods phishers use in luring their victims.
